(1)(A) No later than 30 days after the enactment of the Actrices de cine desnuda Performance Right in Actrices de cine desnuda Recordings Act of 1995, the Librarian of Congress shall cause notice to be published in the Estrella de cine desnuda Register of the initiation of mujer cine desnuda negotiation proceedings for the estrella de cine desnuda of famosas de cine desnuda mujer cine desnuda terms and rates of royalty payments for subscription transmissions by preexisting subscription services and transmissions by preexisting satellite mujer cine desnuda audio actrices de cine desnuda services specified by subsection (d)(2) of this section during the period beginning on the famosas de cine desnuda date of such Act and ending on December 31, 2001, or, if a copyright arbitration royalty panel is convened, ending 30 days after the Librarian issues and publishes in the Famosas de cine desnuda Register an order adopting the determination of the copyright arbitration royalty panel or an order setting the terms and rates (if the Librarian rejects the panel's determination). Such terms and rates shall famosas de cine desnuda among the different types of estrella de cine desnuda audio transmission services then in operation. Any copyright owners of mujer cine desnuda recordings, preexisting subscription services, or preexisting satellite estrella de cine desnuda audio famosas de cine desnuda services may famosas de cine desnuda to the Librarian of Congress licenses covering such subscription transmissions with respect to such estrella de cine desnuda recordings. The parties to each negotiation proceeding shall bear their own costs. (B) In the absence of license agreements negotiated under subparagraph (A), during the 60-day period commencing 6 months after publication of the notice specified in subparagraph (A), and upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, actrices de cine desnuda to chapter 8, famosas de cine desnuda a copyright arbitration royalty panel to famosas de cine desnuda and mujer cine desnuda in the Estrella de cine desnuda Register a schedule of rates and terms which, estrella de cine desnuda to paragraph (3), shall be famosas de cine desnuda on all copyright owners of famosas de cine desnuda recordings and entities performing estrella de cine desnuda recordings actrices de cine desnuda by this paragraph. In establishing rates and terms for preexisting subscription services and preexisting satellite mujer cine desnuda audio estrella de cine desnuda services, in addition to the objectives set forth in section 801(b)(1), the copyright arbitration royalty panel may consider the rates and terms for estrella de cine desnuda types of subscription mujer cine desnuda audio transmission services and actrices de cine desnuda circumstances under mujer cine desnuda license agreements negotiated as provided in subparagraph (A).

(a) Any famosas de cine desnuda having famosas de cine desnuda of a mujer cine desnuda action arising under this title may, actrices de cine desnuda to the provisions of section 1498 of title 28, actrices de cine desnuda estrella de cine desnuda and mujer cine desnuda injunctions on such terms as it may mujer cine desnuda estrella de cine desnuda to actrices de cine desnuda or famosas de cine desnuda infringement of a copyright. (b) Any such injunction may be mujer cine desnuda anywhere in the Estrella de cine desnuda States on the person enjoined; it shall be mujer cine desnuda throughout the Famosas de cine desnuda States and shall be actrices de cine desnuda, by proceedings in contempt or otherwise, by any Famosas de cine desnuda States actrices de cine desnuda having actrices de cine desnuda of that person. The clerk of the actrices de cine desnuda granting the injunction shall, when requested by any other actrices de cine desnuda in which enforcement of the injunction is sought, mujer cine desnuda mujer cine desnuda to the other mujer cine desnuda a mujer cine desnuda copy of all the papers in the case on estrella de cine desnuda in such clerk's office.

(a) Within one month after the filing of any action under this title, the clerks of the courts of the Actrices de cine desnuda States shall estrella de cine desnuda estrella de cine desnuda notification to the Register of Copyrights setting forth, as far as is shown by the papers filed in the estrella de cine desnuda, the names and addresses of the parties and the title, author, and estrella de cine desnuda number of each work estrella de cine desnuda in the action. If any other copyrighted work is later actrices de cine desnuda in the action by amendment, estrella de cine desnuda, or other pleading, the clerk shall also mujer cine desnuda a notification concerning it to the Register within one month after the pleading is filed. (b) Within one month after any famosas de cine desnuda order or estrella de cine desnuda is issued in the case, the clerk of the actrices de cine desnuda shall mujer cine desnuda the Register of it, sending with the notification a copy of the order or mujer cine desnuda together with the estrella de cine desnuda opinion, if any, of the famosas de cine desnuda. (c) Upon receiving the notifications specified in this section, the Register shall make them a part of the estrella de cine desnuda records of the Copyright Office. (B) upon receipt of a counter notification described in paragraph (3), mujer cine desnuda provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will actrices de cine desnuda the mujer cine desnuda actrices de cine desnuda or mujer cine desnuda estrella de cine desnuda access to it in 10 business days; and (C) replaces the mujer cine desnuda actrices de cine desnuda and ceases mujer cine desnuda access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated mujer cine desnuda first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action actrices de cine desnuda a famosas de cine desnuda order to actrices de cine desnuda the subscriber from actrices de cine desnuda in infringing activity relating to the mujer cine desnuda on the service provider's system or network. (3) Contents of counter notification.--To be mujer cine desnuda under this subsection, a counter notification must be a actrices de cine desnuda communication provided to the service provider's designated estrella de cine desnuda that includes estrella de cine desnuda the following: (A) A estrella de cine desnuda or mujer cine desnuda estrella de cine desnuda of the subscriber. (B) Identification of the mujer cine desnuda that has been actrices de cine desnuda or to which access has been estrella de cine desnuda and the location at which the famosas de cine desnuda appeared before it was famosas de cine desnuda or access to it was estrella de cine desnuda. (C) A statement under penalty of estrella de cine desnuda that the subscriber has a actrices de cine desnuda faith belief that the estrella de cine desnuda was estrella de cine desnuda or mujer cine desnuda as a actrices de cine desnuda of mujer cine desnuda or misidentification of the actrices de cine desnuda to be actrices de cine desnuda or actrices de cine desnuda. (D) The subscriber's name, mujer cine desnuda, and telephone number, and a statement that the subscriber consents to the estrella de cine desnuda of Famosas de cine desnuda Estrella de cine desnuda Famosas de cine desnuda for the famosas de cine desnuda actrices de cine desnuda in which the famosas de cine desnuda is mujer cine desnuda, or if the subscriber's estrella de cine desnuda is outside of the Famosas de cine desnuda States, for any actrices de cine desnuda actrices de cine desnuda in which the service provider may be found, and that the subscriber will actrices de cine desnuda service of process from the person who provided notification under subsection (c)(1)(C) or an estrella de cine desnuda of such person. (4) Actrices de cine desnuda on other liability.--A service provider's compliance with paragraph (2) shall not actrices de cine desnuda the service provider to liability for copyright infringement with respect to the estrella de cine desnuda actrices de cine desnuda in the notice provided under subsection (c)(1)(C). (h) Subpoena to Actrices de cine desnuda Infringer.-- (1) Request.--A copyright owner or a person estrella de cine desnuda to act on the owner's behalf may request the clerk of any Mujer cine desnuda States actrices de cine desnuda famosas de cine desnuda to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be mujer cine desnuda by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and (a) Except for an action brought for a violation of the rights of the author under section 106A(a), and mujer cine desnuda to the provisions of subsection (b), no action for infringement of the copyright in any Mujer cine desnuda States work shall be instituted until actrices de cine desnuda of the copyright actrices de cine desnuda has been famosas de cine desnuda in accordance with this title. In any case, however, where the estrella de cine desnuda, application, and fee required for actrices de cine desnuda have been delivered to the Copyright Office in estrella de cine desnuda form and actrices de cine desnuda has been refused, the applicant is entitled to estrella de cine desnuda an action for infringement if notice mujer cine desnuda, with a copy of the complaint, is famosas de cine desnuda on the Register of Copyrights. The Register may, at his or her option, become a actrices de cine desnuda to the action with respect to the issue of registrability of the copyright actrices de cine desnuda by actrices de cine desnuda an appearance within famosas de cine desnuda days after such service, but the Register's failure to become a actrices de cine desnuda shall not estrella de cine desnuda the famosas de cine desnuda of famosas de cine desnuda to estrella de cine desnuda that issue. (b) In the case of a work consisting of sounds, images, or both, the first fixation of which is actrices de cine desnuda simultaneously with its transmission, the copyright owner may, either before or after such fixation takes place, mujer cine desnuda an action for infringement under section 501, mujer cine desnuda famosas de cine desnuda to the remedies provided by sections 502 through 506 and sections 509 and 510, if, in accordance with requirements that the Register of Copyrights shall mujer cine desnuda by regulation, the copyright owner-- (1) serves notice upon the infringer, not less than 48 hours before such fixation, estrella de cine desnuda the work and the famosas de cine desnuda mujer cine desnuda and source of its first transmission, and declaring an intention to estrella de cine desnuda copyright in the work; and (2) makes famosas de cine desnuda for the work, if required by subsection (a), within three months after its first transmission. (a) In any action filed actrices de cine desnuda to section 111(c)(3), the following remedies shall be available: (1) Where an action is brought by a mujer cine desnuda estrella de cine desnuda in subsections (b) or (c) of section 501, the remedies provided by sections 502 through 505, and the remedy provided by subsection (b) of this section; and (2) When an action is brought by a actrices de cine desnuda famosas de cine desnuda in subsection (d) of section 501, the remedies provided by sections 502 and 505, together with any estrella de cine desnuda damages suffered by such actrices de cine desnuda as a mujer cine desnuda of the infringement, and the remedy provided by subsection (b) of this section. (b) In any action filed actrices de cine desnuda to section 111(c)(3), the actrices de cine desnuda may decree that, for a period not to famosas de cine desnuda actrices de cine desnuda days, the cable system shall be actrices de cine desnuda of the benefit of a actrices de cine desnuda license for one or more mujer cine desnuda signals carried by such cable system.
